Terms of Service
The agreement between PE Pathway and subscribing schools — written in plain English.

These Terms of Service govern access to and use of the PE Pathway™ platform, operated by Fit4Fun Sports Dance & Fitness Limited. By activating a school account, the subscribing school agrees to these terms.
1Definitions

| "School Data" | Pupil names, assessment grades, and teacher account information entered by the School. |
| "Subscription" | The annual licence agreement between PE Pathway and the School. |
2The Service
PE Pathway™ provides:
- Access to structured, ability-differentiated PE session content for primary school teachers
- A class marking and pupil assessment system with three differentiated levels: Working Towards, Expected, and Greater Depth
- AI-generated end-of-block and annual report narratives based on class marking data
- A school admin dashboard showing whole-school PE delivery progress
- An Ofsted-aligned reporting tool for PE leads and headteachers
- Safety guidance for each sport, providing risk awareness information for class teachers
PE Pathway reserves the right to update, improve, or modify platform features at any time. Material changes will be communicated to schools by email with reasonable notice.
3Subscriptions and Licences
- Each subscription covers a fixed number of teacher licences as set out at the point of purchase
- Licences are assigned to named teachers within a single school
- Licences may not be shared between schools or transferred to a different institution without prior written agreement
- One School Admin account is included with every subscription at no additional cost
- Subscriptions run for 12 months from the date of activation and renew annually unless cancelled

4Licence Reassignment
Teacher licences are assigned to individual accounts but are not permanently tied to a named individual. If a teacher leaves the school, goes on long-term leave, or is otherwise unavailable:
- The licence can be reassigned by the School Admin to a new or covering teacher at any time
- Reassignment does not affect class data — all pupil names, session marks, and assessment history remain attached to the year group
- The outgoing teacher's account is deactivated on reassignment and they immediately lose access to the platform
- A deactivated account cannot be reactivated by the teacher themselves — only the School Admin can reassign or reinstate a licence
5Temporary Cover Licences
Every subscription includes one free temporary cover licence, available in the following circumstances:
- The cover licence may be activated by the School Admin when a teacher is absent due to maternity leave, long-term illness, or other extended absence
- The absent teacher's account moves to Dormant status — their data, class register, and assessment history are fully preserved
- The cover teacher receives a standard teacher account linked to the dormant teacher's class
- The cover licence is time-limited to one academic term, renewable on request by contacting [email protected]
- When the original teacher returns, the School Admin deactivates the cover account and reactivates the original in a single action
- One cover licence is available per school per academic year as standard. Schools requiring a second should contact [email protected] — this will be accommodated at no additional charge at PE Pathway's discretion
6Payment
- Subscription fees are processed via the platform's self-serve billing portal, powered by Stripe
- Annual subscriptions are charged in advance; monthly subscriptions are charged at the start of each billing cycle
- All prices are exclusive of VAT where applicable
- PE Pathway reserves the right to suspend access if payment fails and is not resolved within 30 days
- Pricing may be subject to annual review. Schools will be notified of any price changes no less than 60 days before their renewal date
7Acceptable Use
The School agrees to use PE Pathway™ only for legitimate educational purposes within the subscribing school. The School must not:
- Share login credentials between teachers or with individuals outside the school
- Attempt to copy, reverse engineer, or reproduce PE Pathway™ platform content
- Use the platform to store data unrelated to PE assessment
- Attempt to access accounts or data belonging to other schools
- Use the platform in any way that violates applicable law or regulation
8Platform Content
All Platform Content — including session plans, diagrams, vocabulary, progressions, and regressions — is the intellectual property of Fit4Fun Sports Dance & Fitness Limited and is protected by copyright.
The School is granted a non-exclusive, non-transferable licence to access and use Platform Content for internal educational delivery purposes during the active subscription period. This licence does not permit:
- Reproduction or redistribution of Platform Content outside the school
- Use of Platform Content after the subscription has ended or been cancelled
- Sharing Platform Content with competing platforms or third parties
AI-generated report narratives produced by the platform are based on the School's own marking data. Once generated and reviewed, these narratives belong to the School and may be used in school reports without restriction.
9School Data
The School retains ownership of all School Data — pupil names, assessment grades, and teacher information — entered into the platform. PE Pathway™ processes this data solely for the purpose of delivering the platform service.

10Cancellation
10.1 Cancellation by the School
The School may cancel its subscription at any time via the billing portal or by providing written notice to [email protected]. Upon cancellation:
- The School's account and all associated data remains accessible for 30 days from the cancellation date
- During this 30-day window, the School may export all School Data via the admin dashboard
- After 30 days, all School Data is permanently and irreversibly deleted from PE Pathway servers
- No refund is provided for the unused portion of an annual subscription
- If the School re-subscribes after the 30-day deletion window, they will begin with a completely fresh account and no historical data will be recoverable
10.2 Cancellation by PE Pathway
PE Pathway reserves the right to suspend or terminate a school account in the following circumstances:
- Non-payment of subscription fees beyond 30 days of the due date
- Breach of these Terms of Service
- Misuse of the platform or its content
In the event of termination by PE Pathway for reasons other than breach or non-payment, a pro-rata refund will be provided for the remaining subscription period. The School will be given 30 days to export their data before deletion.
PE Pathway will never sell, transfer, or share School Data with any competitor platform or third party, including in the event of cancellation, account closure, or company restructuring.
11Liability
- PE Pathway does not guarantee uninterrupted access to the platform
- PE Pathway is not liable for any loss of data resulting from circumstances outside our control
- PE Pathway's total liability in any 12-month period shall not exceed the annual subscription fee paid by the School
- PE Pathway is not responsible for the content of AI-generated report narratives after they have been reviewed and used by the School
12Governing Law
These Terms of Service are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
